Introduction
These Terms and Conditions govern the use of the ChatterBots website and the services provided by ChatterBots. By using this website or engaging our services, you agree to these Terms and Conditions.
Services
ChatterBots provides website design, website makeovers, website maintenance and related online presence services for small businesses.
The exact scope of work will be agreed upon before work begins and may vary depending on the selected package or quotation.
Quotations
All quotations are provided without obligation and remain valid for 30 days unless otherwise stated.
Any work requested outside the agreed quotation may result in additional charges
Payments
Unless otherwise agreed in writing:
- Website design and makeover projects require a 60% deposit before work begins.
- The remaining 40% is payable before the completed website is published or handed over.
- Smaller fixed-price services may require full payment in advance.
- Website maintenance plans are billed monthly in advance and are payable by EFT on or before the first day of each month.
The completed website will only be published or transferred once the final payment has been received.
Client Responsibilities
To help us complete your project efficiently, clients are responsible for providing requested content, images, logos and feedback within a reasonable time. Delays in providing information or approvals may affect the estimated completion date.
Intellectual Property
Unless otherwise agreed, ownership of the completed website transfers to the client once all outstanding invoices have been paid in full. ChatterBots reserves the right to display completed projects within its portfolio and marketing material unless the client requests otherwise.
Third-Party Costs
Domain registration, website hosting, premium plugins, stock photography and other third-party services are not included unless specifically stated in the quotation.
Domains and Hosting
Clients remain the owners of their domain name and hosting account.
Where requested, ChatterBots can assist with registering domains or setting up hosting accounts, but ownership always remains with the client.
Clients are responsible for the ongoing renewal costs of their domain name and hosting unless otherwise agreed.
Website Content
Clients are responsible for supplying the text, photographs, logos and other content required for their website unless otherwise agreed.
By providing content, the client confirms that they have the necessary rights or permission to use it.
Revisions
Reasonable revisions are included during the design process.
Requests that substantially change the agreed project scope may require a revised quotation.
Completion
Project timelines depend on the timely supply of content, feedback and approvals from the client.
Delays in providing information may affect the estimated completion date.
Website Maintenance
Maintenance services are provided only while an active maintenance agreement is in place.
Clients without a maintenance plan may request updates at ChatterBots’ standard hourly rate or current pricing.
Search Engine Optimisation
Every website includes basic search engine optimisation, including page titles, meta descriptions, XML sitemaps and other technical SEO fundamentals.
ChatterBots cannot guarantee search engine rankings, website traffic or business results.
Refunds
Due to the time involved in providing website design and digital services, refunds cannot generally be offered once work has commenced.
If a project is cancelled before work begins, any payments made may be refunded, less any costs already incurred.
Each situation will be considered fairly and reasonably.
Limitation of Liability
While every reasonable effort is made to provide reliable services, ChatterBots cannot be held liable for any loss, interruption, business interruption, loss of profits or damages arising from the use of this website or the services provided.
ChatterBots cannot be held responsible for interruptions or issues caused by third-party providers, including hosting companies, domain registrars, WordPress plugins or Google services.
Changes to These Terms
These Terms and Conditions may be updated from time to time.
The latest version will always be available on this website.
Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
